The Failure of the 28-Article Peace Initiative for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe felt a moment of respite on Monday, as the diplomatic emergency caused by the introduction of a new 28-point plan for ending the war appeared – momentarily – to have been stabilised. A senior US official spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its response: an extensive attack of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The chain of opposing developments captured the grim essence of the current period. By day, negotiation efforts are fought: optimistic declarations are issued from multiple capitals. Considerable effort is allocated on restraining certain initiatives. By night, Moscow clearly shows the world that, for them, military action persists as the main instrument for achieving "settlement".

After-Dark Attacks

As Russia's attack unfolded into the early hours of Tuesday, the present situation of Ukraine's exposure was laid bare. Ukraine is able to track rocket firings from enemy soil, a capacity provided through timely intelligence. From observation points, defense planes that had been scrambled to engage hostile guided weapons roared overhead – advanced fighter aircraft provided to Ukraine by Western partners.

Moments later, Kyiv's anti-aircraft weapons engaged: defensive missiles targeted at a Russian ballistic missile. This was a sophisticated defense system at work, presumably supplied through Western nations. Every firing shakes the surroundings, causing tremors. The brief panic quickly gives way to grim resignation: perhaps the approaching threat won't cause damage this time, preventing destruction from catastrophe and further power outages.

Persistent Threats

Not long after, a large-caliber weapon fired at a drone in the vicinity, part of a defensive team – probably imported technology. Sadly, the projectiles didn't strike the enemy aircraft – it maintained course toward its objective.

Intermittently, this persisted until dawn. Kyiv faced the daybreak reports: multiple fatalities, devastation and infrastructure problems in many homes as a result of the nocturnal offensive. As always, everyone still went about their day – experiencing conflict. But those entire period illustrated Ukraine's vital need on external assistance – a dependence that regional partners are demonstrably unable to replace in the near term.

Unsuccessful Negotiations

The comprehensive proposal from American leadership generated strong feelings, controversy and serious worry – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after earlier high-level meetings and international summits.

Every new initiative from Washington follows the consistent cycle: a negotiation push against Ukraine, which Kyiv, with allied governments, manages to fend off. They manage the tension but never actually win the battle. This trend will, no doubt, continue.

Political Considerations

It is tempting to accuse certain parties of persistently promoting Moscow's conditions. But that does not seem to be the whole story. Washington works based on a assumption understood by seasoned negotiators: you cannot achieve through diplomacy what you have been unable to protect through force. The American government believes that it is unrealistic to force Russia to relinquish the areas that it currently occupies in Ukraine's southern or eastern regions.

The problem is that while accepting these circumstances, Washington does nothing to discourage Russia, through statements or actions, from assuming that the status quo will not change more in its benefit in the coming year.

Conflicting Perspectives

Therefore, the Kremlin is certain that time is on his side – that Ukraine and its allies are nearing depletion. Their motivation to accept conditions that does not give them the greatest potential benefit is close to zero. There may be many attempts to end hostilities, but they will persist as long as Russia's leadership remains supremely confident in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still hold out, gradually sacrificing lives and land but preventing a total frontline collapse until situations evolve in its advantage.

Present Conditions

Objectively, there are no real preconditions for a ceasefire. Now, subjective factors are entering the equation: leadership ambitions to broker a ceasefire and achieve global acclaim, and Ukrainian leadership's dual difficulties – on one hand, not to distance important partners, and on the other, to mobilize citizens around the national cause against any plan Kyiv finds unacceptable, so that their attention does not move to internal issues. And although their task will now be considerably more difficult after latest incidents, it remains very improbable that this will modify their basic position.

These two forces are guiding negotiations.

Assessment and Future

It took a only one week to terminate the 28 points of the current initiative. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, recent disclosures, all achieved their purpose.

While new proposals based on established approaches are approaching, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and demonstrate specific hesitation to alter the situation, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the predictable period, mainly require sustained allied backing.
